How can the promotion and facilitation of foreign direct investment be reconciled with the demands of environmental and social sustainability? To what extent can the negotiation of new international investment agreements prevent human rights abuses and environmental damage in the context of cross-border investment? This book addresses the tension between investment protection and sustainability, from the perspectives of different stakeholders. Drawing on insights from the public and private sector, NGOs, legal practice and academia, it analyses the main instruments developed to balance investor protection with state regulatory autonomy in the pursuit of social and environmental goals. Through a combination of legal analysis and policy reflection, the volume examines emerging treaty practice, arbitral trends, and reform initiatives aimed at embedding environmental and social sustainability into the international investment protection regime.

Marco Argentini is Assistant Professor of International Law at the Department of Law of the University of Naples ‘Federico II’ and Adjunct Professor at the Italian Naval Academy. He is admitted to the Italian Bar.

Ludovica Chiussi Curzi is Associate Professor of Public International Law at the Department of Legal Studies of the University of Bologna and Legal Advisor to the Office of the State Attorney of the Republic of Italy on cases before the European Court of Human Rights and before international investment tribunals.

Attila M. Tanzi is Full Professor of Public International Law at the Department of Law of the University of Bologna, Associate Member of 3VB Chambers, and President of the Italian Branch of the International Law Association.
